Please read these consumer terms and conditions carefully. These terms and conditions constitute a legal agreement between you and Organic Foodie, as defined below.

Acceptance of the Terms

Welcome to the Organic Foodie. Please note that availing yourself of our services hereby declares that you agree to our terms and conditions. If you disagree, please refrain from using our services. These terms and conditions govern your use of the Organic Foodie mobile application (“App”) and services provided by Organic Foodie (“we,” “us,” or “our”). Organic Foodie is an LLC, having a registered office at (Office address) with (EIN Number). By using the Organic Foodie, you confirm that:

  • You are at least 18 or the legal age of majority in your jurisdiction.
  • You agree to comply with the terms and conditions of Organic Foodie.
  • You have the legal capacity to enter into a binding agreement.
  • If you are using the app on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Description of Services

Organic Foodie is a marketplace platform that connects sellers of organic foods (“sellers”) with buyers (“buyers”). We provide a transaction platform but are not directly involved in selling or purchasing products. We do not guarantee the quality, safety, and legality of any products listed on the app. Organic Foodie operates as an online marketplace to broker the exchange of goods and services among you and other consumers, other businesses, and third-party contractors who provide delivery and offer you access to information on the services. The Organic Foodie allows consumers to order food or other goods and request services from Merchants. Organic Foodie notifies the consumers when their product is picked up and delivered. Consumers can track their orders through the mobile application of the Organic Foodie. The application provides customer support that helps consumers ease canceling or modifying the order.

The specific information or services available to the consumer may vary according to the delivery or pickup address selected by the consumer. User means an individual who uses the services of the Organic Foodie with or without an account and should agree to these terms and conditions. If a user doesn’t want to agree to the terms of the Organic Foodie may not access or use the services.

User Accounts

  • Registration: The user first needs to register with Organic Foodie. To use certain features of the app, you must create an account. You agree to provide accurate and complete information during registration. The user must create an account on the organic Foodie platform and provide accurate and completed information.
  • Account Security: The user is responsible for maintaining the confidentiality of their account credentials and all activities under their account.
  • Termination: We reserve the right to suspend or terminate your account if you violate these terms and conditions and engage in fraudulent activities. The users can place orders through the Organic Foodie, and the orders are subject to acceptance by the sellers.
  • Pricing: The online marketplace decides pricing, which may vary. You agree to pay all the charges, including food costs, taxes, delivery fees, and tips, using payment methods available on the Organic Foodie. The application may charge a service fee from the user for using the Organic Foodie.
  • Cancellations and Refunds: Cancellations of orders are subject to the online marketplace. Refunds, if applicable, will be processed based on the marketplace's policy.
  • Seller Responsibilities: Sellers are responsible for accurately listing their products, including descriptions, pricing, and certifications (e.g., organic certifications).
    - Sellers must comply with all applicable laws and regulations for selling organic foods.
    - Sellers are responsible for fulfilling orders and resolving disputes with Buyers.
  • Seller Disclosure: Organic Foodie Seller Disclosure Agreement** This Seller Disclosure Agreement ("Agreement") is entered into by and between [Seller's Full Name] ("Seller") and Organic Foodie ("Platform") as of [Date]. By signing this Agreement, the Seller acknowledges and agrees to the following terms regarding the sale of organic products through the Organic Foodie platform.
  • Organic Certification: The Seller represents and warrants that all fruits, vegetables, and other products listed for sale on the Organic Foodie platform are grown, harvested, and handled in accordance with organic farming practices. The Seller confirms that their products are 100% organic, free from synthetic pesticides, herbicides, fertilizers, and genetically modified organisms (GMOs).
  • Compliance with Organic Standards: The Seller agrees to comply with all applicable organic standards and regulations as defined by [relevant local, state, or national organic certification bodies, e.g., USDA National Organic Program (NOP) or equivalent]. If the Seller holds an organic certification, they must provide valid certification details to Organic Foodie for verification.
  • Accuracy of Product Information: The Seller agrees to provide accurate and truthful information about their products, including but not limited to the type of produce, growing methods, and any certifications. The Seller acknowledges that misrepresentation of products as organic may result in removal from the Platform and potential legal action.
  • Liability and Indemnification: The Seller agrees to indemnify and hold harmless Organic Foodie, its affiliates, and its users from any claims, damages, or liabilities arising from the sale of non-organic or misrepresented products. The Seller assumes full responsibility for the quality, safety, and organic integrity of their products.
  • Inspection and Verification: Organic Foodie reserves the right to request documentation or conduct inspections to verify the organic status of the Seller's products. The Seller agrees to cooperate fully with such requests.
  • Termination of Agreement: Organic Foodie reserves the right to terminate this Agreement and remove the Seller from the Platform if the Seller is found to violate this Agreement or any applicable organic standards.
  • Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law principles. By signing below, the Seller acknowledges that they have read, understood, and agreed to the terms of this Agreement.

Buyer Responsibilities

Buyers review product listings and ensure they meet their requirements.
- Buyers must comply with payment terms and provide accurate shipping information.
- Buyers are responsible for inspecting products upon delivery and reporting any issues within a reasonable timeframe.

Payments and Fees:

- Organic Foodie may charge transaction fees or commissions for using the platform. These fees will be disclosed to Sellers and Buyers.
- Payments are processed through third-party payment gateways. You agree to comply with their terms and conditions.

Intellectual Property:

All content on the App, including logos, text, graphics, and software, is the property of Organic Foodie or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our prior written consent.

Limitation of Liability:

Organic Foodie is not liable for any indirect, incidental, or consequential damages arising from your use of the App. We are not responsible for the actions or conduct of Sellers or Buyers.

Dispute Resolution:

Any disputes arising from using the App will be resolved through negotiation, mediation, or arbitration as agreed by the parties.

Changes to Terms:

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes your acceptance of the revised Terms.

Governing Law:

Rules and Prohibitions
